Learned Counsel for the Petitioner submits that this petition, which is filed under Section 9 of the Arbitration and Conciliation Act, 1996, may be taken by his client before the arbitral forum, which is now in place pursuant to an order passed by this court under Section 11 of the Arbitration and Conciliation Act.

The petition is permitted to be withdrawn with liberty to place the same before the learned arbitrator as an application under Section 17 of the Arbitration and Conciliation Act. The Resolution Professional appointed in respect of the Respondent company by NCLT, Mumbai is directed to represent the company before the arbitral forum. (S.C. GUPTE, J.)
