Heard learned counsel for the Plaintiff.

Learned counsel for the Plaintiff submits that inadvertently they have paid excess Court fee of Rs.3,00,000/-. To that effect, he is relying on a Certificate dated 20.4.2017 issued by the Prothonotary and Senior Master. He has made the averment in paragraph 4 of his affidavit dated 26.4.2017 in support of the Judges' Order.

Considering the submissions made by learned counsel for the Plaintiff and averments made in para 4 of the Affidavit dated 26.4.2017, I am satisfied that the Plaintiff has made out a case for allowing this Judges' Order.

Hence the same is allowed.
