DECEMBER 03, 2018.

P.C. :

This Arbitration Petition has been filed under Section 29A of the Arbitration and Conciliation Act, 1996, seeking an extension of time for a period of six months to complete the arbitration proceedings and pass a final award.

The learned advocate appearing on behalf of Respondent Nos. 4 and 5 who is present in the Court has submitted that Respondent Nos.1,2 and 3, though being represented before the Arbitrator have not been served with this Arbitration Petition. Pg 1 of 2

2.carbp.730.2018.doc The learned advocate appearing on behalf of the Petitioner states that Respondent Nos.1,2 and 3, though sought to be served at the addresses mentioned in cause title of this petition, and which was also the addresses mentioned in the arbitration proceedings, however, the packets have come back with the remarks "receivers not available" and "shifted".

Considering that this Petition is only seeking an extension of time to compete the arbitration proceedings, I allow the same. The time to complete the arbitration proceedings and pass a final award is extended for a period of six months from today. It is further directed that the Arbitral Tribunal shall give fresh notices to all the Respondents to appear before it at a time and place duly mentioned in the said notices. The Arbitration Petition is disposed of in the aforesaid terms. There shall be no order as to costs. (B.P.COLABAWALLA, J.) Pg 2 of 2
