Learned Counsel appearing for the Plaintiffs has sought leave to withdraw the Suit No. 979 of 2018 and withdrawal purshis dated 24th March 2022 has been tendered, which is taken on record and marked as 'X' for identifcation. SHARAYU PANDURANG KHOT by SHARAYU PANDURANG KHOT Date:

The withdrawal of the above Suit is in terms of the Compromise Deed dated 31st January 2022 and in particular, 1/2

4-S-979-18.doc Clause 3 thereof, whereby the parties have agreed that the proceedings including the above Suit before this Court shall be withdrawn unconditionally.

Accordingly the Suit No. 979 of 2018 is disposed of as withdrawn in accordance with the Compromise Deed between the Plaintiff and the Defendant.

In view of disposal of the Suit, Interim Applications, if any, are also disposed of, as become infructuous. 5.

Court fees are to be refunded in accordance with the Rules. For the purposes of Section 43 of the Maharashtra Court Fees Act and the proviso to that Section, today's date is the date of making a claim for repayment. The Prothonotary & Senior Master will issue a certifcate for a refund of Court Fees computed according to the Rules. He will act on production of an authenticated copy of this order without requiring a separate application.
