Versus

Trina Cyrus Ghaswala ...Plaintiff No. 2 Ms. Sanobar Nanavati, for the Plaintiffs.

CORAM: G.S. PATEL, J DATED:

24th April 2015 PC:- 1.

This is a suit for divorce by mutual consent under Section 32-B of the Parsi Marriage & Divorce Act, 1936. The 1st Plaintiff is the husband and the 2nd Plaintiff is the wife. They were married on 31st January 2010 in Mumbai according to Zoroastrian rites and ceremonies. This was the 1st Plaintiff's second marriage and the 2nd Plaintiff's first. The Plaintiffs have no children. 2.

After marriage, both Plaintiffs cohabited and lived together at the 1st Plaintiff's address at 623, Marker Mansion, Lady Jehangir Road, Dadar (East), Mumbai - 400 014.

DOC 3.

Shortly after the marriage, differences arose between the Plaintiffs. These grew over time. On 10th February 2014, the 2nd Plaintiff-wife left the Dadar home and came to reside with her parents at 2nd Floor, Flat No. 4, 2/B, Sonawala Building, Tardeo, Mumbai 400 007.

4.

The parties have attempted, without success, to reconcile their disputes. They have been living apart for more than one year prior to the presentation of this suit. They have between themselves arrived at consent terms and these are annexed at Exhibit "B" to the plaint. I have seen these consent terms. They seem to be in order. Provisions have been made for the division of investments and separation of personal items.

5.

In these circumstances, the marriage of the parties is dissolved under Section 32-B of the Parsi Marriage & Divorce Act, 1936. There will also be a decree in accordance with the consent terms, Exhibit "B" to the plaint. Decree to be drawn up accordingly.

6.

All concerned to act on an authenticated copy of this order. (G. S. PATEL, J.)
