ORDER

We are inclined to dispose of the present Writ Petition as in spite of repeated adjournments there is no response coming from concerned Collector, respondent No.2 though time was granted to take instructions so that appropriate steps can be taken by Collector to recover the money as per certificate dated 23.11.2012 issued by the Assistant Commissioner of Labour, Mumbai towards the claim of the petitioner (labour) as contemplated under Section 33 C (1) (4) of the Industrial Dispute Act. After considering the averments made and as the statement is that the said certificate is not even challenged by respondent Nos.3 & 4, Employer/Management, therefore, there is no 1/2
(18) WP 1689-14 reason that such certificate should not be executed by taking due course of law. As not done, therefore, we are allowing this petition in terms of prayer clause (a) and direct the respondent to take steps as expeditiously preferably within 4 months.

The petition is disposed of with liberty. No order as to costs.
