This Petition is under Clause XII of the Letters Patent. The present Suit is for declaration and damages against the Defendants. The contract of agency which is the subject matter of the Suit was executed in Mumbai and the letter of termination was issued by the Defendant No. 2 to the Plaintiff at 1 / 2 July 17, 2019

903-LPETN-97-19.doc their factory address at Mumbai. The Defendant No. 1 is resident of New Delhi, although during the employment of the Plaintiff, he was reporting to the management of Mumbai on monthly/quarterly basis and would come to Mumbai office on regular basis. The Defendant No. 2 is a company incorporated and carrying on business in Germany.

I am satisfied that the material part of cause of action has arisen within the jurisdiction of this Court. Accordingly, leave is granted under Clause XII of the Letters Patent. This Court will have jurisdiction to entertain and try the Suit.

3.

The Petition is made absolute.
