Heard learned Counsel for the Petitioner, learned AGP and learned Counsel for the Respondent-Corporation. It is pointed out by learned Counsel for the Petitioner and learned Counsel for the Respondent-Corporation that apart from the representations of the Petitioner and the Respondent-Corporation, CREDAI-MCHI has also made representation to the Urban Development Department, Government of Maharashtra in seeking clarifcation under the Regulation 4(3) of DCPR 2031 essentially in respect of Regulation No. 48(5)(A).

Having regard to the facts and circumstances of the case, we dispose of the Petition by the passing the following order: AKN 1/2

ORDER

(i) The representation of the Petitioner dated 04.08.2020 to the Urban Development Department alongwith the representations of Respondent-Corporation dated 10.09.2020, the representation of the CREDAI-MCHI and any other connected representations, if any, shall be decided by the concerned Principal Secretary, Urban Development Department expeditiously and in any event within eight weeks from today after hearing all concerned through virtual hearing.

(ii) We make it clear that we have not gone into the merits of the matter.
