The counsel for the plaintiff seeks leave to withdraw the suit. The allowed to be withdrawn. The counsel for the defendant states that substantial time and effort has been put in and costs has been incurred by the defendant in defending this action which had proceeded upto even filing of evidence by the plaintiff and marking of documents. Therefore, the counsel for the defendant requests that substantial costs be imposed. The counsel for the plaintiff states that some of the documents have been marked subject to proof of truth of contents thereof and since the officers who were with the plaintiff to give instructions in the matter at the relevant time, are no more in the employment, a conscious decision was taken by the plaintiff to withdraw the suit.

1.s.1870.2009.doc Taking into account this background, a sum of Rs.50,000/- is to be paid by the plaintiff to the defendant as costs and this amount has to be paid within four weeks from today. Cheque to be issued in favour of the advocate for the defendant.
