The Petition is for leave under Clause XII of the Letters Patent. The Suit is an action in trade mark infringement sought to be combined with a cause of action in passing off. Some of the Defendants are outside Mumbai. A material part of cause of action has arisen in Mumbai. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
