This Notice of Motion has been taken out for condonation of 219 days delay in filing appeal from the order dated 17th April, 2014, passed by the Income Tax Appellate Tribunal. Perused the affidavit in support of Notice of Motion explaining the circumstances in which delay took place. Bearing in mind that the appellant does not regularly file appeals before this Court in income tax matters the circumstances set out in the affidavit would be sufficient cause justifying the condonation of delay. Accordingly the Notice of Motion is allowed in terms of prayer clause (a).
