Mrs Uma K Wagle, for the Respondent.
CORAM: G.S. PATEL, J DATED:
23rd April 2018 PC:- 1.
None for the Revocation Petitioner. The Respondent obtained Letters of Administration on 28th January 2010 to the property and credits of one Shivraj Ambaprasad Gupta, who died in Mumbai on 29th July 2006.
2.
The Revocation Petitioner sought revocation of the grant of Letters of Administration inter alia on the ground that Shivraj purportedly left a Will dated 10th October 2003 and that he had filed Testamentary Petition No. 84 of 2013 for Probate. This was later renumbered as Testamentary Suit No.73 of 2014. At the time 23rd April 2018
38-MPT130-16.DOC of the filing of the Revocation Petition, that Testamentary Suit was still pending.
3.
I am now informed by Mrs Wagle that the Testamentary Suit was dismissed on 28th June 2017 (RD Dhanuka J). 4.
In view of this, and further since the Revocation Petitioner is absent today, the present Petition is also dismissed. There will be no order as to costs.
