Petitioner seeks Legal Heirship Certificate under Section 2 of Bombay Regulation VIII of 1827, in respect of one Alex John Alexander who died on 15/07/2020. Copy of his death certificate is annexed at Exhibit C to the petition.

Petitioner is the widow of deceased. Petitioner and the deceased have two children Tanya John and Joel John aged 27 and 22 years respectively. Both these children have filed their respective affidavit in support of the petition. In fact, in their affidavit, the two children have Purti Parab

2/2 39-MPT-21-2021.doc also stated that they relinquished all their claims, title or interest in the property of the deceased in favour of their mother - petitioner and the company to transfer the property in her name. The heirship certificate is required for petitioner to receive the dues which the family of the deceased was entitled to from his employer in Kuwait.

It is also averred in the petition that there are no other application made to any District Court or District Delegate or any High Court for probate of any will or letters of administration with or without the will annexed thereto or for succession. Mr. Agarwal states that no other petition for heirship certificate or succession certificate has been filed. Statement accepted.

Thus, petition is made absolute in terms of prayer clause (a) in favour of petitioner Ranjini John, Tanya John and Joel John. 5.

Miscellaneous Petition No.21 of 2021 stands disposed. All Interim Applications stand disposed.
