Heard the learned counsel for the parties.
By this petition, under Article 226 and 227 of the Constitution of India, petitioner is challenging the order passed by respondent no.2 appointing Mr.Arvind Janardan Kamble, as authorised officer in respect of respondent no.3 Society.
The learned A.G.P. appearing on behalf of State filed affidavit of Mr.Arvind Janardan Kamble, Head Clerk in the office of the Assistant Registrar, Co-operative Societies, F/S Ward, Mumbai disclosing the Mohite 1/2
902 wpl1275-17 election program in paragraph 4.
After considering the submission of the parties, statement made by Mr.Arvind Janardan Kamble in paragraph 4 of the affidavit dated 6.5.2017 is accepted. It is made clear that authorised officer to complete the election of respondent no.3 Society as per the schedule disclosed in paragraph 4. It is made clear that till the elections held and results declared, the authorised officer should not take any policy decision in respect of the Societies matter, but he can conduct day to day business of the Society and make appropriate payment for that. In view of these facts, the learned counsel for the petitioner seeks permission to withdraw the petition.
Same is granted.
