---- CORAM : K.R.SHRIRAM,J DATE : 25.11.2016 P.C.:- Following the order dated 21.10.2016, Mr.Bhushan P.Malgaonkar, advocate is present in Court, so also Mr.Devendra A.Naik and Mrs.Aarti Devendra Naik who are petitioner nos.2 & 3. Hoping that parties will see some reason and understanding that what they have done by filing the contempt petition which was dismissed, was not correct and hoping that they would apologize and give an undertaking to the Court not to resort such petition in future, I asked the advocate Mr.Malgaonkar and Mr.Devendra A.Naik and Mrs.Aarti Devendra Naik whether they would apologize to the Court and also give an undertaking not to file such proceedings or indulge in vilification of Judges which would KJ

CONP48.14-910 lower the authority of the Courts. Mr.Devendra A.Naik and Mrs.Aarti Devendra Naik expressed regret and gave an undertaking that they will not ever indulge in vilification of Judges or do anything that would lower the authority of the Courts. This order was explained to these two persons in Marathi by the Associate of this Court. Therefore, Show Cause Notice as against Mr.Devendra A.Naik and Mrs.AartiDevendra Naik stands discharged.

As regards advocate Mr.Bhushan P. Malgaonkar, he flatly refused to apologize and refused to give undertaking that he would not indulge in vilification of Judges or do anything that would lower the dignity of the court.

Mr.Bhushan P.Malgaonkar seeks some more time to file reply to the Show Cause Notice as according to him Show Cause Notice was only issued on him on 18.11.2016. Time is granted to Mr.Bhushan P.Malgaonkar upto 9.12.2016 to file affidavit in reply. Matter be listed on 16.12.2016.
