Heard the Petitioner appearing in person. The breach alleged is of Clause 7 of the judgment and order dated 17th April 2012 passed by a Division Bench of this Court. The Division Bench of this Court by the said judgment and order dismissed the Appeal preferred by the Petitioner against the order of the learned Single Judge dated 24th January 2012 by which a Writ Petition filed by the Petitioner was dismissed. Under Clause 7 of the judgment and order dated 17th April 2012, a liberty has been granted to the Petitioner to file appropriate proceedings if the Respondent No.4 Developer does not complete the project and does not offer the Appellant permanent alternate accommodation by 30th April 2014.

According to us, no case of breach of the said order is made out. However, remedy of the Petitioner to take appropriate proceedings in terms of Clause 7 of the judgment and order dated 17th April 2012 is expressly kept open. The Petition is disposed of. (A.A. SAYED, J) (A.S.OKA, J)
