The Application is under Section 29-A of the Arbitration and Conciliation Act, 1996. The previously appointed Arbitrator has, after entering upon the reference, indicated that he is unable to continue for a variety of personal reasons. Parties have been so informed by the learned sole Arbitrator. They are agreed that the matter should be referred to the sole Arbitration of Mr Sushrut Desai, an Advocate of this Court.

The name of the previously-appointed Arbitrator is thus substituted with the name of Mr Sushrut Desai. 4th November 2019

I am informed that the Arbitration is at a very early stage. The statement of claim has not yet been filed. Mr Desai, the learned sole Arbitrator, will fix a schedule and will consider all applications including the application for condonation of delay, if necessary, in exercise of his powers as the learned sole Arbitrator. It is, however, clarified that the time for completing the Arbitration will commence from the date Mr Desai enters upon the reference to his Arbitration. 4.
