2. This review petition has been preferred against the order dated 02.04.2019 passed by this Court dismissing Income Tax Appeal No.247 of 2017 filed by the assessee.

3. Be it stated that the appeal was filed by the assessee under section 260A of the Income Tax Act, 1961 against the order dated 04.11.2016 passed by the Income Tax Appellate Tribunal, ' A' Bench, Mumbai in I.T.A. No.1562/Mum/2015 for the assessment year 201011.

4. The review petition is before us on a praecipe filed by learned counsel for the review petitioner.

5. It is submitted that the assessee has opted for settlement under the Direct Tax Vivad se Vishwas Act, 2020 whereafter Form No.3 has been issued to the review petitioner. In that view of the matter, review petitioner seeks to withdraw the review petition.

6. Learned counsel for the respondent has no objection to the prayer made.

7. In that view of the matter, review petition is disposed of as withdrawn.

8. Refund as per Rules.
