Learned counsel for respondent No.1 bank stated under instructions that the bank had deposited a sum of Rs.3,50,000/- towards the gratuity payable to the petitioner which is presently lying with the controlling authority. He stated that the gratuity was withheld because the petitioner was not vacating the ofcial residence after retirement. Now the petitioner has vacated the premises, the bank has no objection to the said amount being paid over to the petitioner. Under the circumstances, the competent authority shall release the gratuity amount of Rs.3,50,000/- in favour of the petitioner with accrued interest if any. 2.
