After having heard Mr.Madon, learned Senior Counsel for the applicants/plaintiffs on the Notice of Motion no.65 of 2015 and the learned Counsel for the defendant-Tadeshwarwadi CHS Ltd., in my opinion, it would be in the interest of justice that the parties be referred for mediation by constituting a mediation panel. Accordingly, the parties are referred for mediation of Mr.Fredun E. De Vitre, Senior Advocate of this Court. The parties shall approach the Mediator on the date as may be mutually fixed by the learned Mediator. It would be permissible for the learned Mediator to take assistance of a registered Architect on the panel of the High Court, or any other Architect as the parties may agree. Learned Mediator shall endeavour to hold an early meetings with the parties and place a report on the record this notice of motion, which be done within a period of two weeks from today. 2.

Notice of Motion no.11 of 2013 be placed for hearing on 3 December 2019 alongwith Notice of Motion No.65 of 2015. [G.S. KULKARNI, J.]
