Mr. S. A. Sawant, learned Counsel for the Applicants states that the

3/3 Learned Advocate for the original Petitioners are served with a copy of the Chamber Summonses and affidavit in support of chamber summonses. He also states that affidavit of service is already filed. Statement is accepted. By these Chamber Summonses the Applicants seek condonation of delay of 30 days in filing the Caveat. I have perused the averments made in the affidavit in support of the Chamber Summonses. In my view, the Applicants have explained the delay of 30 days in filing the Caveat in paragraph 4 of the affidavit in support. The delay of 30 days in filing the Caveat is accordingly condoned. No order as to costs.

The Office is directed to accept the Caveat filed by the Applicants and to convert the Petition No.274 of 2017 into a suit. (R. D. DHANUKA, J.)
