For the reasons set out in the Affidavit in Support and despite the vigorous opposition of learned Advocate for the Petitioner, who, in fairness, leaves it to the Court, Chamber Summons is made absolute in terms of prayer clauses (a) and (b). 2.

The delay in filing the Caveat is condoned. Affidavit in Support to be filed and served on or before 6th July 2015, with no possibility of an extension. If the Affidavit in Support is not filed by that day, the Caveat to stand discharged without further reference to the Court and the petition to proceed without contest from the present Applicant. Upon the Affidavit in Support being filed, the Petition to be renumbered as a suit and to be listed for framing issues on 15th July 2015 on supplementary board. (G. S. PATEL, J.)
