The Petition is for leave under Clause XII of the Letters Patent. The Suit is a derivative action and challenges certain actions in regard to a company. A material part of the cause of action has arisen in Mumbai. Some of the Defendants are outside the jurisdiction of this Court. With leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
