The Petition is directed against the Shipping Corporation of India Limited. If the Shipping Corporation of India limited seeks a relief against Bharat Heavy Electricals Limited, then the Shipping Corporation India limited J.V.Salunke,PA

NMW.178.2014.6.doc must adopt its own proceedings so as to protect its legal rights if any.

2) This Motion is completely misconceived. It is dismissed with liberty to the Shipping Corporation of India Limited to adopt appropriate proceedings. The order passed on 11th September, 2014 shall continue for a period of eight weeks from today to enable the Respondent Shipping Corporation of India Limited to adopt appropriate proceedings in pursuance of the above liberty.
