Learned advocate appearing on behalf of the Petitioner states that her client is bed-ridden and suffering from Cancer and, therefore, does not wish to prosecute the Petitions any more. Since the Company Petitions were already admitted, the withdrawal thereof were ordered to be advertised. Accordingly, the withdrawal of these Petitions has been duly advertised in "Free Press Journal" Pg 1 of 2

903.cp.534.2008.doc (in English) on 7 October, 2010 and in "Maharashtra Times" (in Marathi) on 8 October, 2010. Pursuant to these notices, advocates M/s M.V.Kini & Company representing Hongkong Shanghai Banking Corporation Limited, Mumbai claiming to be unsecured creditors of the Respondent Company, informed the Liquidator that their clients intended to oppose the withdrawal of these Petitions. Despite this letter, no opposition has been filed by the said Hongkong Shanghai Banking Corporation Ltd. and none have appeared on their behalf today. Apart from this, no other person has come forward to oppose withdrawal of this Petition.

In this view of the matter, the Company Petitions are allowed to be withdrawn and are disposed of accordingly. No order as to costs.
