Shri Yatin Shah, counsel appearing for the petitioner states that respondent nos. 3 and 4 have also been served but nobody has entered appearance on their behalf. Respondent Nos.3 and 4 also are not present today.

Shri Shah, counsel appearing for the petitioner, Mr. Hiren G. Shah, counsel appearing for the respondent No.1 and Mr. Vaishnawa, counsel appearing for respondent No.2 state that their clients are agreeable, if Mr. Salil M. Shah, an Advocate practicing in this Court is appointed as an Arbitrator instead of Tribunal of three Arbitrators appointed earlier by the party read with order dated 21st February, 2003 passed by this Court in Arbitration Application No.263 of 2002. It is also stated that respondent no.1 is the main contesting party. The counsel present today also state that Mr. Salil M. Shah, Advocate has consented to his appointment as Arbitrator. Therefore, Mr. Salil M. Shah, Advocate is appointed as an Arbitrator and Mr. Shah will continue from the stage which was before the earlier Tribunal. Since this dispute relates to late 1990/early 2000, Mr. Shah is requested to ensure that the Arbitration proceeding is completed at the earliest. 4.

The petition accordingly stands disposed.
