Heard the learned counsel for the petitioners and the learned counsel for the respondent.

At this stage, the learned counsel for the respondent-Bank points out that possession of the subject office premises has been taken by the respondent-bank through the Receiver of the Debts Recovery Tribunal on 9th May 2019.

In view of above, the learned counsel for the petitioners seeks leave to withdraw the writ petition with liberty to make appropriate application before the Debts Recovery Tribunal.

The learned counsel for the petitioners also points out that the Shraddha Talekar PS 1/2

923-wpl-1556-2019.doc respondent-bank is merged with Bank of Baroda and that the respondentbank is proceeded before the Debts Recovery Tribunal without reflecting the name of Bank of Baroda.

We grant permission to the petitioners to withdraw the petition with liberty as prayed. All contentions of the petitioners are kept open. The writ petition is disposed of as withdrawn.
