DATED :- JULY 12, 2016 P.C. :- By this writ petition under Article 226 of the Constitution of India, the petitioners seek a writ of mandamus or any other appropriate writ, order or direction, directing the respondents to complete the process of demarcation of lands acquired by the petitioners or correct the requisite Revenue records of the village boundaries. This relief, according to the petitioners, is based on the survey carried out by these respondents.
2) After the petition was heard on the earlier occasion, we orally directed Mr. Mane learned AGP appearing for the respondents to take instructions and inform the court on the next date whether in terms of the survey document/map can the corrections be carried out or otherwise.
3) Today, it is stated by Mr. Mane that respondent no. 3 is present in court.
4) The City Survey Officer will now take the necessary steps to rectify the village records of the two villages, details of which are mentioned in the writ petition and thereafter issue a Property Register Card. If any corrections have to be carried out in the Revenue records, which were earlier maintained, even those will be carried out.
5) After taking instructions, Mr. Mane informs the court that within a period of two months from today, the exercise as requested by the petitioners will be carried out and a Property Register Card in the form prayed by the petitioners would be issued to them. The petitioners need not attend the office of any of the respondents, but the respondents will themselves take the requisite steps as above and issue the Property Register Card to them.
6) After we have such a statement made by the learned AGP on instructions, then, nothing further needs to be done and at the request of the petitioners. The writ petition need not be kept pending. It is, accordingly, disposed of. 7) Needless to clarify that when the Property Register Card will now be issued to the petitioners, that would indicate the location of the petitioners' land and traceable to specific villages, namely, Majas and Oshiwara.
