This petition under section 29A seeks extension of time by the Arbitral Tribunal to make its award.

The record indicates that after the preliminary meeting held on 25 th June, 2016 meetings were held between August, 2016 upto April, 2018 as seen from the minutes annexed to this proceeding.

Learned counsel for the respondent undertakes to file appearance within a period of one week from today. On behalf of the respondent the application is opposed. There is no affidavit in reply although respondent were served in July, 2018. The reference is now pending for final arguments and in the circumstances I
3-arbp-611-2018 deem it appropriate to extend time by a period of six months from today since the reference is now at an advanced stage.

On behalf of the respondent learned counsel states that he will appear before the arbitral tribunal on the next date fixed and will continue to appear before the tribunal. In the event the respondent does not so appear before the arbitrator, it will be open to the arbitrator to proceed in their absence ex-parte. No further application for extension of time will be considered. 5.
Petition disposed of in the above terms.
