Heard the learned Advocates appearing for the parties and the following order is passed :

i.

The Defendants have handed over two demand drafts of Rs.51 Lacs and Rs.64 Lacs respectively drawn in favour of the Applicant / Plaintiff to the Advocates for the Plaintiff.

ii.

The Defendants undertake to pay an amount of Rs.1 Lac to the Applicant / Plaintiff towards interest / cost within a period of one week from the date of this order. The undertaking is accepted. 2.

In view of this order, the Applicant / Plaintiff seeks to withdraw the

Nitin 2 / 2 926-NMSL-3290-2015 above Notice of Motion as well as Suit. The Notice of Motion as well as Suit are therefore disposed of as withdrawn. Refund of Court Fees, if any, as per Rules. 3.

Save and except the payment of Rs.1 Lac as undertaken in Clause (ii) above, the parties shall not have any claim whatsoever against each other and all pending proceedings in regard to the Suit claim (Civil and / or Criminal) shall be withdrawn / not pressed.
