1] This notice of motion is taken out on behalf of plaintiffs to condone the delay of 1964 days in taking out notice of motion and to set aside an order dated 15th January 2008 passed by the Prothonotary & Senior Master, dismissing the suit for non compliance of Rule 87 of Bombay High Court (O.S.) Rules and to restore the suit.

2] When the notice of motion was listed on 14th September 2015, it was stood over to today. Even though the matter was called out twice today, once in pre-lunch session and once in post lunch
