The above Petition filed under Article 226 of the Constitution of India seeks a direction against the Respondent No.2 to conclude the inquiry initiated against the Respondent No.1 developer for removing it as developer of the Slum Rehabilitation Scheme in question. The second direction is sought to the effect that the Respondent No.2 be directed to decide the complaint dated 22-4-2015 filed by the Petitioners and other members of the Respondent No.4 as expeditiously as possible.
The Learned Counsel appearing on behalf of the Respondent No.2 Mr. Patil points out that the representation of the Petitioners has already been mmj
wp-1321-16-(5) disposed of by observing that since the project is on going the Slum Rehabilitation Authority would verify whether the conditions of the LOI have been complied with before granting any further approvals. The Learned Counsel further points out that under directions of the State, the Slum Rehabilitation Authority has undertaken a review of the pending Slum Rehabilitation Scheme which are under implementation. It seems that pursuant thereto a show cause notice dated 8-12-2016 has been issued to the Respondent No.1 by Slum Rehabilitation Authority under Section 13(2) of the Slum Act. In the light of the said show cause notice, in our view, it is not necessary now to keep the above Petition pending as it is expected of the Slum Rehabilitation Authority that it would take a decision one way or the other pursuant to the said show cause notice. With the aforesaid observations, the Writ Petition is disposed of.
