Learned counsel for the petitioners fairly concedes that the Writ Petition would not be maintainable in view of the seven Judges Bench of the Supreme Court in S.B.P. and Co. vs. Patel Engineering Ltd. and Anr., reported in MANU/SC/1787/2005 and in particular paras 44 & 46 thereof.
