Learned counsel appearing for the applicant states that the respondent has been served. Statement is accepted. None appears for the respondent when the matter was called out. No affidavit-in-reply is filed. 2.
I have heard the learned counsel for the applicant and have perused the averments made in affidavit-in-support of the notice of motion.

Delay is not fully explained. However, in the interest of justice, on payment of costs quantified at Rs.25,000/- which shall be paid by the petitioner to the Maharashtra Legal Services Authority within two weeks from today, notice of motion is made absolute in terms of prayer clauses (a) and (b). The arbitration petition is restored to file. No order as to costs.

The applicant is directed to produce receipt of payment of cost before the learned Prothonotary and Senior Master. If the amount of cost is not paid by the applicant/petitioner within two weeks from today, the order passed by this Court allowing the notice of motion in terms of prayer clauses (a) and (b) to stand vacated without further reference to the Court. If the amount of cost is paid within two weeks from today, place the matter on board for 'Admission' on 22nd March 2018. R.D. DHANUKA, J.
