This Motion is for annulment of insolvency under Section 21(2) of the Presidency Towns Insolvency Act, 1909. Learned Counsel for the applicant submits that the insolvent has already paid his debts to the creditors and seeks leave to withdraw the Motion with liberty to file a fresh Motion under the provisions of Section 21(1) of the Presidency Towns Insolvency Act, 1909. The Motion is dismissed as withdrawn with liberty as prayed. There shall be no order as to costs.
