The learned Special Counsel for the State of Maharashtra has placed on record a copy of the order dated 8th June 2018 issued by the State Government. The same is taken on record and marked `O-1' for identification. The said order records that the deputation of the fifth respondent as the Managing Director of the fourth respondent has been cancelled and the fifth respondent has been repatriated. The learned counsel for the petitioner submits that the manner in which the fifth respondent was appointed as the Managing Director of the fourth respondent is completely illegal and therefore, the challenge to the legality and validity of the orders
oswp2166.doc which is made by way of prayer (a) will have to be gone into especially in view of the fact that the fifth respondent had victimised the petitioner. According to us, in view of the order dated 8th June 2018, the issue has become academic and therefore, the same need not be considered. However, the contentions which are raised by the petitioner will have to be kept open. As regards, prayer(c), considering the fact that main challenge does not survive, the petition need not be entertained. Accordingly, writ petition is disposed of. However, all contentions raised by the petitioners are kept open.
