The parties have settled their disputes and difference in terms of Settlement Agreement dated 16th May 2018. The said Settlement Agreement is tendered today. The same are taken on record and marked "X" for identification. All undertakings therein are accepted.

In light of the settlement, Ld. Advocate for the Plaintiff seeks to withdraw the present Suit. Statement Accepted. The Suit is allowed to be withdrawn.

Refund of Court Fees as per Rules.

There are no caveats against release of the Defendant no. 1 barge.

Order of Arrest dated 6th May 2015 passed in the Suit stands vacated.

Instrument of release dispensed with.

Defendant no. 2 undertakes to pay poundage within 7 days from today.

All concerned including Port, Customs and other statutory authorities shall act on an ordinary copy of this Order, duly authenticated by the Associate of this Hon'ble Court. 9.

The Defendants are at liberty to communicate this Order along with Letter from the Sheriff of Mumbai to all Authorities / Port and Customs by fax/ email / hand delivery.

Liberty to the parties to mention the matter in case of any difficulty.
