Heard Mr. Sham Walve, learned standing counsel, revenue for the appellant and Ms. Jasmin Amaladvala, learned counsel for the respondent - assessee. 2.

The learned counsel for the respondent pointed out that in the order giving effect to the decision of the Tribunal relief granted by the Tribunal has been mentioned and if the tax effect is so calculated comes below one crore. Learned counsel for the appellant seeks time to take instructions.

Today, when the matter is called upon, Mr. Walve submits that he has received written instructions from Pr. Commissioner of Income Tax -8, Mumbai dated 27.1.2020 to withdraw the appeal as the tax effect involved is below the prescribed monetary limit as per CBDT Circular No. 17/2019 dated 8.8.2019.

In that view of the matter, the appeal is disposed of as withdrawn.
