Heard the learned counsel appearing for the Petitioner and the learned counsel appearing for the Respondent. The learned counsel appearing for the Respondent has no instructions as to whether representation made by the Petitioner dated 15 th March, 2013 was heard and the same has been decided. Considering the nature of the representation and the averments made in the Petition regarding the alleged policy of the Respondent - Corporation, if the representation has not yet been decided, the Municipal Corporation will have to decide the same.

Accordingly, we dispose of the Petition by passing the following order :-

ORDER

(i) If appropriate decision on the representation of the Petitioner has been already taken by the Respondent - Corporation, the same shall be communicated to the Petitioner within a period of two weeks from today. If the said representation has not yet been decided, the same shall be decided in accordance with law within a period of four weeks from the date on which an authenticated copy of this order is produced by the Petitioner before the concerned officer of the Municipal Corporation; (ii) All contentions on merits are kept open;

(iii) The Petition is disposed of on above terms;

(iv) All concerned to act upon the authenticated copy of this order.
