Mr.Karl Shroff i/by Dhru & Co. for the defendants. ---- CORAM : K.R.SHRIRAM,J DATE : 6.4.2017 P.C.:- Mr.Karl Shroff for the defendants tenders a compilation of 11 documents today which is marked "X" for identification. At the outset, Mr.Shroff states that documents at serial nos.1, 2 & 3, they will have to introduce through other witnesses who can prove those documents. Mr.Shroff states that document at serial no.1 is already on record as Y-3 and so far as documents at serial nos.5 & 10, the defendants will not be relying on those documents. As regards documents at serial nos.4, 6, 7, 8, 9 & 11,

Mr.Sanglikar for the defendants states that the same can be received in evidence and marked as exhibit subject to cross-examination. Mr.Shroff also is agreeable. Therefore, these six documents are received in evidence and marked Exh.D-16, Exh.D-17, Exh.D-18, Exh.D-19, Exh.D-20 and Exh.D-21, respectively. Mr.Sanglikar states that he does not wish to crossexamine DW-1 Sudhir Multani on any of these documents which have been received today in evidence. Mr.Shroff states that there are certain other documents which have been introduced during the cross-examination of defendants' first witness but they have not been received in evidence. Mr.Shroff states that depending on whether the court receives those documents, the defendants will be able to take decision whether any further evidence is required by other witness.

In view of the above order, Notice of Motion disposed. By consent, stand over to 21.4.2017 for directions. (K.R.SHRIRAM,J)
