M/S Supreme Industries Limited v. Shri Ramkrishna Mandal
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
ORDINARY ORIGINAL CIVIL JURISDICTION NOTICE OF MOTION NO.277 OF 2015 IN REVIEW PETITION (L) NO.16 OF 2015 IN WRIT PETITION NO.2254 OF 2014 Supreme Industries Limited ....Applicant/Orgn. Petitioner In the matter between Supreme Industries Limited ....Petitioner V/s.
Shri Ramkrishna Mandal ....Respondent.
Mr. A. P. Wachasunder, Advocate for the Applicant/Orgn. petitioner. Mr. Prithviraj Singh, Advocate for the respondent. CORAM : Smt. R. P. SondurBaldota, J.
DATE : 21st July, 2015.
P.C.:
1.
This notice of motion is taken out for condonation of delay of 76 days in filing the petition for review of the order dated 19th November, 2014. At paragraph 3 of the affidavit in support of notice of motion the petitioner states that copy of the order appeared on the website in December,2014 and thereafter the same was handed over to it in the month of January, 2015. The affidavit in support of notice of motion does not name the person who had received it on behalf of the petitioner. Thereafter the petitioner has contacted it's advocate who on account of his
preoccupation was not inclined to take steps in the matter. Thereafter the petitioner approached the present advocate in the month of February and the petition for review came to be filed in the month of March, 2015.
2.
The above reason set out can hardly be said to be satisfactory for condoning the delay. Besides the claim made is vague and without necessary particulars. Hence the Notice of Motion is dismissed. As a consequence the review petition does not survive and the same is accordingly disposed off.
