There is no dispute that the arbitration agreement exists. Since the erstwhile arbitrator Shri Justice C.K. Thakker has resigned, the applicant has filed the present application for appointment of an arbitrator under section 11(6) of the Arbitration & Conciliation Act, 1996.

By consent of the parties, Hon'ble Shri Justice F.I. Rebello, former Chief Justice of the Allahabad High Court is appointed as the sole arbitrator.

The arbitration application is disposed of in the aforesaid terms. No order as to costs.
