Learned counsel appearing for the applicant submits that Mrs. Tarlaben Harish Mehta died on 4/12/2011. The death certificate issued by the Health Department of Municipal Corporation of Greater Mumbai is annexed at Exhibit "A" to the application. Affidavit-in-support

chs-806-12 of the application is filed by the original appellant no.1, husband of deceased Tarlaben Mehta.

In view of the affidavit filed and the submissions advanced, Chamber Summons is allowed in terms of Clause (A) of the Schedule annexed to the Chamber Summons and leave is granted to the applicant to amend the cause title in Appeal No. 95 of 2010 and Notice of Motion No.2124 of 2010.
