Ms. Shah for Defendants Nos. 1 to 3 and Mr. Jayakar for the Plaintiff states that the matter is settled out of Court. Ms. Shah seeks leave to withdraw her Caveat on behalf of Defendants Nos. 1 to 3. The other heirs though served but have not filed any Caveat. The Defendant is No. 2 is personally present in Court. He is the Constituted Attorney of Defendants Nos. 1 and 3. 2.

In view thereof, the Suit is decreed. Testamentary Petition No. 927 of 2007 is made absolute in terms of prayer clause (a). Letters of Administration are to be issued on a priority basis.
