1. Ld. Advocate for the petitioner submitted that she has moved a praecipe for Court Fee exemption in TP(L)/14511/2023.
2. Ld. Advocate for the petitioner submitted that property has received under Probate granted in TP/ 2871/2022 in pursuance of the Will executed by Shalini Walawalkar.
3. It is appeared that property mentioned in the probate was bequeathed to son and daughter in law of the Shalini Walawalkar. Said Shalini was having 50% share in the said property. However, remaining 50% share belongs to deceased namely Ramchandra Walwalkar. Said Ramchandra Walwalkar died intestate. Hence, his legal heirs file the present petition for Letters of Administration. Therefore, Ld. Advocate for the petitioner submitted once stamp duty has been paid for part of the estate though the owner of the estate is different then, in subsequent petition for grant of Letters of Administration or other similar payment of Court fee is not required. Hence, adjourned for order in TP(L)/14511/2023.
