Dusane 2/2 CHW182.2015 The respondent desires to be represented in the domestic enquiry by one P.P. Saher. There is a dispute as regards the status of P.P. Saher as the General Secretary of the applicant and as the employee of the petitioner. The dispute about being General Secretary is sub-judice in other proceedings.
Mr. Naidu, the learned advocate for the respondent admits that Mr. P.P. Saher is no longer an employee of the petitioner-Company, he having been retired from service. He also makes a statement that the representation by Mr. Saher in the departmental enquiry will not be in his capacity as General Secretary of the recognised union i.e. Indian Hotels Company Employees Union. In view of the statement made, the Chamber Summons by the recognised union for impleading itself to the petitioner does not survive. The same is according disposed off.
