This Petition is under Clause XII of the Letters of Patent. The present Suit is for recovery of monies for goods sold to the Defendant. The Defendant had placed the orders for the goods at Mumbai. All communications for the transactions have been received and sent from Mumbai. The Defendant is liable to 1 / 2 July 8, 2019

3-LPETN-121-19.doc pay the suit claim to the Plaintiff at Mumbai. The part payments were made by the Defendant at Mumbai. The Defendant is situated outside Mumbai.

I am satisfied that the material part of cause of action is arisen within the jurisdiction of this Court. Accordingly, leave is granted under Clause XII of the Letters Patent. This Court will have jurisdiction to entertain and try the Suit. 3.

The Petition is made absolute.
