There is no dispute that the arbitration agreement exist between the parties. By consent of parties Mr.Shyam Kapadia, Advocate is appointed as the sole arbitrator. Arbitration application is disposed of in the aforesaid terms. 2.

All other issues except the issue about existence of arbitration agreement and about the name of the learned arbitrator are kept open. 3.

Learned counsel appearing for the applicant has agreed to provide photocopies of the records pertaining to the subject matter of dispute which would be requisitioned by the advocate of the respondent within one week from today. Copies of such record shall be furnished by the applicant's advocate within two weeks from the date of such requisition by respondent on payment of requisite charges if any. Arbitration application is disposed of in the aforesaid terms. No order as to costs.
