CHAMBER SUMMONS NO.95 OF 2017 This chamber summons is taken out for leave to amend the plaint as per the Schedule annexed to the chamber summons. On 3rd July, 2017 none appeared for MMRDA, the proposed defendant. Therefore, plaintiff was directed to reserve the chamber summons alongwith copy of the order passed on 3rd July, 2017. Plaintiff has filed an affidavit of service of one Prashant Girkar affirmed on 6th July, 2017 confirming service. Still nobody from MMRDA has remained present or entered appearance.

Therefore, chamber summons is allowed in terms of prayer clause - (a) and accordingly disposed.

Defendant nos.1 to 3 to file additional written statement and newly added defendant no.4 to file written statement within four weeks of receiving copy of the amended plaint.
