On 21st June 2016, Mr.Bodake, Advocate instructed by Chitnis Vaithy & Co. stated that they have been receiving instructions only from plaintiff no.2 and therefore, they will take steps within one week to file an application to transpose plaintiff no.1 as defendant to the suit. Mr.Sinha for plaintiff no.2/applicant states that no such application has been filed or copy served upon applicant. Mr Mane for defendant nos.4 to 6 also confirms the same.

12.chs.561.2014.s.532.2010.doc Mr.Sinha states that plaintiff no.2 has now instructed Little & Co., the advocates for applicant and plaintiff no.2 have agreed to join applicant as co-plaintiff. During the course of today, Little & Co. will file the Vakalatnama in the registry.

In view of the statement made by Mr.Sinha, chamber summons is allowed in terms of prayer clauses (a) and (b). Amendment to be carried out within two weeks and the amended plaint to be served within one week thereafter.

Chamber summons accordingly disposed.
